PepsiCo’s Gatorade division has filed a lawsuit in U.S. District Court over Coke’s new ad campaign for Powerade Option, a low calorie sports drink. Pepsi claims the commercial is false as well as deceptive. The lawsuit which was filed last Monday seeks a permanent injunction against the campaign. The telecast of the campaign
The suit is seeking a permanent injunction to block Coke from streaming the ads, which were launched only last week during the start of the NCAA men’s basketball tournament.
The suit says
In other words, Coca-Cola is telling consumers that Powerade Option’s fewer calories literally make you go faster. However, Coca-Cola cannot possibly substantiate this overall superiority claim.
