Getting behind to pay bills and owing a considerable amount of money to various contracts is a terrible position to be in. But don’t worry, even if you are neck deep in debts, you still have your rights to tackle your situation in a rightful manner.

Know your rights

Its important to know your rights when you are handling situation where debts and debt collectors are involved. For instance, there is a law that debt collectors are not permitted to divulge your financial matters to any third party without your permission. Debt collectors often have to trace you by contacting your neighbors, your parents or your workplace and if they happen to inform them the purpose of the call, you are allowed to sue them.

Contact period

You’d be surprised to learn that collectors can’t just go on bothering you with calls at any point of time. They can contact you only between 8 am to 9 pm in your respective time zone. Also if you happen to inform them that they can’t contact you at your workplace, they have to take that number off their list as your point of contact. In fact, if for a matter of fact you are represented by an attorney, the debt collectors need to speak with them and not you.

Don’ts of a collector

Debt collectors are in any way not allowed to harass you or lie to you. That’s against the Fair Debt Collection Practices Act ( FDCPA ). Other guidelines in the act includes factors like they can’t call you repeatedly, use profane language and threatening, popularize you as a debtor, misrepresent themselves or their organisation, threaten you by saying that a legal action can be taken against you, mailing you a collection notice by postcard and many more. Keep these rules in mind if you are dealing with debt collectors.
